UN MOMENT CHEZ (hereinafter "Le Jardin by Château Jasson") attaches great importance to protecting and respecting the privacy and personal data ("Personal Data") of the users of its website (hereinafter the "Site").

Le Jardin by Château Jasson undertakes to implement appropriate measures to ensure the protection, confidentiality and security of Personal Data in accordance with the regulations in force in France and in the European Union, in particular the General Data Protection Regulation (EU) 2016/679 of 27 April 2016 and the national rules adopted for its application.

This privacy policy informs users of the practices and processing involved in the collection and use of Personal Data by Le Jardin by Château Jasson as data controller.

Le Jardin by Château Jasson therefore invites users to read this document carefully in order to know and understand how their Personal Data is processed.

Article 1. Personal Data collected

Users may be asked to provide their Personal Data in digital form when using the Site.

In general, users can browse the Site without having to provide any Personal Data to Le Jardin by Château Jasson.

Le Jardin by Château Jasson only collects the Personal Data necessary for the processing it carries out ("privacy by design") and ensures a high level of protection ("privacy by default"). The processing operations requiring the collection of data are the following:

In such cases, the personal information collected from users includes at least: (i) last name(s), (ii) first name(s), (iii) email address, (iv) phone number, (v) postal address, (vi) country.

This Personal Data is then kept for as long as necessary to fulfil the user's request. If no request is completed, it is deleted within the periods recommended by the CNIL, i.e. three years from its collection by the Site, subject to legal possibilities and obligations regarding archiving, retention of certain data and/or anonymisation.

1.2 Browsing information of Site users

When using the Site or certain related services, some data is collected automatically, such as: (i) IP address, (ii) browser software used, (iii) browsing data (date, time, content viewed, search terms used, etc.), (iv) operating system.

Among the technologies used to collect this information, Le Jardin by Château Jasson may use sessions that store each user's data using a unique session identifier. These sessions keep the data in memory only for the duration of the user's visit.

Data collected during browsing is deleted when the user's browser is closed or, where applicable, within a maximum of thirteen months from its collection.

Article 2. Legal basis for collecting and processing Personal Data

Personal Data is processed by Le Jardin by Château Jasson in the cases authorised by the regulations in force and under the following conditions:

Only authorised staff of Le Jardin by Château Jasson and its service providers may access and process the Personal Data collected, without prejudice to its possible transmission to bodies responsible for control or inspection in accordance with the laws and/or regulations in force, or in response to a judicial or administrative decision.

Authorised staff are bound by a duty of confidentiality.

Le Jardin by Château Jasson undertakes not to sell the Personal Data collected to third parties.

Article 4. Transfer of Personal Data

Personal Data collected from Site users is stored exclusively in France and is not transferred outside the European Union.

Where affiliates or service providers located outside the European Union are used, Le Jardin by Château Jasson undertakes to verify that appropriate measures have been put in place so that users' Personal Data benefits from an adequate level of protection.

Article 5. Data security

Le Jardin by Château Jasson collects and processes users' Personal Data with the utmost confidentiality and in compliance with applicable laws. Users are protected against unauthorised access, modification, disclosure or destruction of their Personal Data.

Where disclosure of Personal Data to third parties is necessary and authorised, Le Jardin by Château Jasson ensures that these third parties provide the same level of protection as it does, and requires contractual guarantees so that Personal Data is processed exclusively for the purposes accepted by users, with the required confidentiality and security (in particular through the European Commission's standard contractual clauses, binding corporate rules ("BCR") or the data protection framework between the European Union and the United States of America).

Le Jardin by Château Jasson implements technical and organisational measures to ensure that Personal Data is stored securely for as long as necessary for the purposes pursued.

Users' attention is drawn to the fact that no transmission or storage technology is completely infallible.

In the event of a proven breach of Personal Data likely to result in a high risk to the rights and freedoms of users, Le Jardin by Château Jasson will notify the competent supervisory authority in accordance with the applicable regulations.

Users are responsible for taking care to prevent unauthorised access to their Personal Data, in particular to their computers and digital devices (computer, smartphone, tablet).

The Site may occasionally contain links to websites of partners or third-party companies that have their own privacy policies.

Le Jardin by Château Jasson has no control over the content of these sites and declines all responsibility for the use made of information collected when users click on these links.

Le Jardin by Château Jasson therefore invites users to read the data protection policies of these sites before sending them any personal information.

Article 7. Users' rights

Users have the following rights, subject to the limitations provided for by the legislation in force.

Le Jardin by Château Jasson undertakes to make every effort to provide concise, transparent and accessible information on how users' Personal Data is processed.

7.2 Right of access to Personal Data

Each user may access the Personal Data processed by Le Jardin by Château Jasson and has the right to receive a copy in electronic form (for any additional copy, Le Jardin by Château Jasson may charge a fee based on administrative costs).

7.3 Right to erasure ("right to be forgotten") and rectification of Personal Data

Each user has the right to request the deletion and/or rectification of their Personal Data when it is incorrect or out of date.

Le Jardin by Château Jasson may retain certain Personal Data where required by law or for legitimate reasons.

7.8 Right to decide what happens to Personal Data after death

Users also have the right to give general or specific instructions on what should happen to their Personal Data after their death, which Le Jardin by Château Jasson undertakes to respect.

In the absence of such instructions, Le Jardin by Château Jasson recognises the heirs' ability to exercise certain rights, in particular the right of access where necessary for settling the deceased's estate, and the right to object.

7.9 How to exercise these rights

To exercise their rights, users are invited to contact the Data Protection Officer of Le Jardin by Château Jasson as described in Article 11.

To help them exercise their rights, the CNIL provides template letters on its website (www.cnil.fr).

Before processing users' requests, Le Jardin by Château Jasson may verify their identity by asking for proof of identity.

The Data Protection Officer will respond to requests as soon as possible and in any event within one (1) month of receiving proof of identity.

If necessary, this period may be extended by two (2) additional months given the complexity and number of requests, in which case Le Jardin by Château Jasson will inform users of the extension and the reasons for the delay.

Article 8. Use of cookies

Depending on their cookie settings, users may agree that the Site stores information about their browsing, in particular to ensure the proper functioning of the Site, to produce visitor statistics and to improve the conditions of use and the services offered.

What is a cookie?

A cookie is a small text file stored on the user's device. It contains some data relating to the connection, in particular the name of the server that created it, usually an identifier in the form of a unique number and possibly an expiry date. Le Jardin by Château Jasson reserves the right to amend this privacy policy at any time in order to comply with legislative and regulatory changes and/or to improve its Personal Data processing and protection policy.

In the event of changes, a new version will be published with the "last updated" date.

Article 10. Applicable law and jurisdiction

This privacy policy is governed by French law, including the rules of private international law.

Failing an amicable agreement, the courts within the jurisdiction of the Aix-en-Provence Court of Appeal shall have jurisdiction, notwithstanding multiple defendants and/or third-party claims, over any dispute relating to the use of the Site and/or the validity, performance and interpretation of this privacy policy.
